Based in Beijing, China this is a local position where the successful candidate will be part of Nokia's Legal and Intellectual Property group. As Legal Counsel, Anti-Counterfeiting the individual will support, direct and manage external counsel and vendors in the region in connection with surveillance and investigations aimed at uncovering infringement of Nokia's brand related intellectual property rights and instituting the appropriate legal remedy.
Responsibilities include the overall planning and execution of various enforcement activities in China:
- Scheduling, planning and traveling to priority "ports" and localities within Mainland China to build strong relationships with local enforcement authorities; familiarizing them with the unique aspects of Nokia products; and providing them with available intelligence on the supply routes and practices of counterfeiters operating in the region;
- Ensuring that all deadlines for responding to notices of seizure related to imports and exports of infringing products and associated equipment and materials and all regulatory requirements are met in a timely manner.
- Instituting and overseeing civil actions in China and negotiating settlements against manufacturers, distributors and suppliers that engage in counterfeiting and/or black market activity;
- Preparing and sending cease and desist letters, either as a preliminary step in the litigation process or as the primary enforcement tool where more aggressive legal remedies are unnecessary, unavailable or inappropriate.
The successful candidate will have demonstrated experience in building a case from the "ground up" in China with the objective of minimizing the burden and dependency upon provincial Chinese officials by providing the relevant authorities with the leads, evidence and support needed to achieve a successful result. This will require personal involvement in each stage of the enforcement process including working with local counsel, investigators and business partners to:
- analyze the availability and effectiveness of different enforcement options for each target;
- generate and evaluate leads obtained from various and multiple sources;
- collect evidence of infringement through test purchases and other investigative techniques;
- determine the appropriate action for each lead and estimate the costs and likely return on investment;
- prepare preliminary reports or other filings necessary to initiate a raid and support a prosecution and/or civil litigation.
The successful candidate will also be responsible for routine monitoring and/or following up on leads of internet sites offering suspicious products originating from greater China including working directly with Chinese based internet service providers to remove or prevent access to offers of infringing product and:
-Developing and participating in a 'notice and takedown' program with Chinese internet service providers
-Subsequent monitoring of suspicious sites and appropriate follow-up action
Qualifications
Legal degree with minimum of 10 years post qualification experience in a law firm and/or corporate law department.
Fluency in English and Mandarin; working knowledge of Cantonese a plus
Strong legal analysis skills with ability to integrate legal advice and business knowledge, and ability to provide balanced advice regarding risks and benefits
Strong interpersonal skills including maturity, creativity and a high energy level
Team-oriented and able to interact effectively and influence peers and all levels of management
Ability to work well in a cross-functional team environment, as well as in a small team environment and become a productive and positive member of the Legal and Intellectual Property department.
Ability to manage and control legal spending while constantly striving to maximize return on that investment
